Girard Clerk of the Court reviews
1 Speed cameras without posted notification that speed is being monitored by photo/ video is a violation of state rights under Section 4511.094 of the Ohio revised code.
Speed cameras are a violation of constitutional rights under the 8th and 14th amendment, where the 8th amendment may concur that a fee of $125 for a civil infraction is unjust and excessive, and where the 14th amendment may argue that speed cameras operated by local jurisdictions present unfair travel circumstances for out-of-state travelers who are at a disadvantage to their in-state, local counterparts, whom largely have learned the location of the camera operated speed traps. (Photo Enforcement Programs: Are They Permissible Under the United States Constitution? , 43 J. Marshall L. Rev. 463 (2010)
In reviewing maps at Anderson Morris road, there is no posted sign that video/photo enforcement is occuring, nor one that is in my memory.
If I had the resources and ability to take time out of my work day to come to court at 1pm on a Thursday, I would come to argue my case in person. But since I cannot, I will pay into your ~ $3 million USD / year (your township's annual speed camera revenue) police department / traffic camera system supplier (who receive money from every ticket written) devisive scheme.
